Terms & Conditions

The following outline concerns both the liability of Rocky Road Travel Limited and the responsibilities of the customer.

The following conditions describe your obligations as a customer when purchasing either an independent tour or a group tour through us. The terms “we”, “us” and “our” refer to Rocky Road Travel Limited. The term “you” refers to the customer.

BOOKING POLICY

A €200 deposit is due upon booking confirmation for most tours. A percentage of the remaining balance is due 2 months in advance with the majority due in cash on arrival on tour. This policy is subject to change depending on the tour destination. 

CANCELLATION POLICY

All cancellation notices must be received in writing and will become effective as of the date of receipt by us. Tour refunds will be calculated based on the information contained in the following table:

  1. Customer is liable for any transaction charges associated with the refund process.
  2. All cancellations incur a minimum €50 administration fee.
  3. The €200 deposit is fully refundable up to 90 days before a tour departure. If the booking is cancelled less than 90 days before a tour then this deposit amount is not refunded.
  4. In the event of the company incurring non-refundable costs and expenses, including, but not limited to flight booking and hotel reservations this shall be deducted from any refund due to the customer.
  5. If circumstances force you to leave the Tour early, you will have to bear any additional costs yourself.

CANCELLATION BY US

We reserve the right to cancel your tour. However, we will not do so unless we are forced to do so by virtue of unforeseen circumstances such as flight cancellations, civil or political unrest or “force majeure”.

We will tell you about any small changes before departure. If we think a necessary change is important, we will tell you about it as soon as we can and give you the opportunity to either accept the change, or take an alternative tour (paying or receiving a refund / credit in respect of any price difference), or cancel and accept a full refund.

We are not liable to you in any circumstances for loss or damage or loss of your holiday when unusual and unforeseeable circumstances arise which are beyond our control, the consequences of which we could not have avoided even with all due care. We are not liable to pay you any additional travel or any other costs, expenses or losses which you incur as a result of any change or cancellation by us, such as changes to times of connecting flights or other travel arrangements. You agree that all these provisions are reasonable.

In the event of an airline cancelling a flight, forcing the Company to cancel a tour, The Company will only reimburse monies it can retrieve. It is up to The Client to have suitable insurance to cover any additional losses.

PASSPORTS & VISAS

As with all travel there is always a minor chance that a visa will be refused.

Our ability to obtain visas for our customers has been on the whole extremely successful and any inability to obtain a visa has always been for cause.

If the customer has provided accurate information and their visa is refused we will grant a full refund of any payments made to us minus associated transaction fees and costs. In addition we will not be held responsible for any costs incurred by the customer in traveling to the location from which their tour was scheduled to depart.

In the event a customer intentionally misleads us in an attempt to enter any of our other destinations depending on our invitation, any deposit paid will be forfeited.

You are responsible for ensuring you have a valid visa* for the destination you are travelling to where required. We will provide you with support paperwork and also advise you on the visa process but you must be aware that visa regulations change constantly and differ between Embassies in different countries. Our advice should only be taken as a guide and you should ensure you are aware of all the up to date requirements from your government state advice and the nearest Embassy of the country you are visiting. *except Socotra & North Korea where we provide the visa.

Medical vaccinations, passports & visas are entirely your responsibility and must be arranged prior to departure. We can take no responsibility for cancellation of your trip in the event that you are not allowed to fly, or continue your tour. If you are unable to travel due to not being able to obtain (or not having) the appropriate visa we reserve the right to retain the cost of the trip.

FORCE MAJEURE

Force majeure is any event or circumstances which we could not, even with all due care, foresee or avoid. Such events may include but are not limited to war, riot, civil strife, terrorist activity, industrial dispute, natural or nuclear disaster, adverse weather or road conditions, fire, bureaucratic obstacles, cancellations & changes in schedules or mode of transport by ferry companies, airlines, bus or train operators and all similar events outside our control.

If such an event or circumstance arises and said event or circumstance results in an inability to proceed with the tour, customer shall be entitled to a refund minus reasonable costs incurred by us.

COVID-19

Rocky Road Travel will not be liable to any extra costs incurred due to treatment due to Covid-19 or additional hotel expenses incurred. Each client understands the risks associated with Covid-19 travel and is fully responsible for taking precautions to prevent the spread of Covid-19.

TRAVEL INSURANCE

Rocky Road Travel expressly disclaim any and all liability for customer’s damages for emotional distress, mental suffering, or psychological injury of any kind, under any circumstances. We have no responsibility in whole or part and customer agrees we are not liable for any and all liability or claims for any occurrences including but not limited to any delay, loss, accidents, personal injury, political unrest, sickness, medical expenses or property damage occurring on tour.

We therefore require all customers to obtain sufficient insurance that, in the event of any possible risk, will provide sufficient cover for customer and if applicable, any dependents he or she is traveling with. It is your responsibility to ensure that the insurance coverage includes, but is not limited to, medical and health cover for an injury or sudden illness while on tour, 24 hour emergency service and assistance (including repatriation if you become too ill to continue the tour), cancellation and curtailment, lost and stolen possessions cover, and personal liability cover. Any claims must be directed towards your insurers.

LOCAL LAWS

Customers are required to follow local laws and regulations at all times. In the result of a breach of local law, we will not be held in any way responsible and the customer will take responsibility for any consequences, financial or otherwise, that arise from their actions.

Customers are required to follow the guidance and company rules of Rocky Road Travel at all times.

We reserve the right to expel without refund, those customers who refuse to abide by company policies.

TOUR ITINERARY

Due to the nature of travel/tourism in the DPRK and our other destinations, itineraries do not provide or imply a guarantee of the tour’s contents. Though we will make every effort to keep itineraries as described and to find suitable replacements, Rocky Road Travel reserve the right to make changes to the itinerary in response to unforeseeable events.

NON-LIABILITY FOR CHANGES

Rocky Road Travel reserves the right to change these terms and conditions at any time and we will notify clients if such changes are made.

Price quotations are subject to change without notice and will not be binding until a booking has been confirmed.

We fully reserve the right to change or amend all itineraries on a case by case basis depending on the situation on the ground. In such cases we will always provide a suitable replacement.

Train, and flight tickets are subject to availability. We reserve the right to change the mode of transport depending on availability.

There is no guarantee that transport provided on the tour will depart at the time specified. If it does not, then we are not liable to you for any delay or cancellation or for any failure to take what you think are the best actions to have taken in particular circumstances.

If for any reason a client does not complete any portion of their tour or abandons their scheduled tour after departure, no refund shall be given nor will any credit be given towards future travel.

ACCEPTANCE OF RISK

Clients are only accepted on the understanding that they fully accept, appreciate and understand the possible risks of a tour and that they agree to take these risks under their own free will. The Client acknowledges that there is a significant element of personal risk in participating on a tour. The Client accepts and consents to the personal risks and accepts the limitations of the Company’s liability set out herein as being reasonable. In particular the extra risks involved in travelling in the countries/regions of Afghanistan, Iraq, Pakistan, Libya, Yemen, Syria, Somalia and other countries against which the German Government Foreign Office (Auswärtiges Amt / Reisewarnungen) advises against all travels to these countries. Furthermore it is to be understood that in many places in which the Company operates as per the brochure standards of hygiene, accommodation facilities, safety and law enforcement may be poor or less than in the client’s own country.

For the aforementioned countries, if they fall under the German Government Foreign Office (Auswärtiges Amt / Reisewarnungen) travel warning, they are therefore not covered for insurance purposes against war, terrorism, civil unrest, protests, general strikes and environmental force majeure. the Company will not be held liable for any effects resulting from these causes. Clients will be deemed to have reasonably informed themselves of current situations in the countries they are travelling too and to have made up their own minds.

TOUR PAYMENT

The advertised price of the tour and the currency in which payment can be made are not guaranteed and, up until the point at which balance has been paid by customer, Rocky Road Travel reserves the right to both alter the price of the tour and refuse payment in any specified currency.

Rocky Road Travel does not accept payment for tours in the DPRK (North Korea) Iran, Syria or Eritrea.

PRIVACY POLICY

This privacy policy only covers information collected at this website, and does not cover any information collected offline by Rocky Road Travel All Rocky Road Travel websites are currently covered by this privacy policy.

SECURITY

Personal information provided on the website and online credit card transactions are transmitted through a secure server. We are committed to handling your personal information with high standards of information security. We take appropriate physical, electronic, and administrative steps to maintain the security and accuracy of personally identifiable information we collect, including limiting the number of people who have physical access to our database servers, as well as employing electronic security systems and password protections that guard against unauthorised access. Our website uses encryption technology, like Secure Sockets Layer (SSL), to protect your personal information during data transport. SSL encrypts ordering information such as your name, address, and credit card number. Our Customer Care center and stores also operate over a private, secure network. Please note that email is not encrypted and is not considered to be a secure means of transmitting credit card information.
